Terms of Service

fiveplate is a personal health analytics platform built around meal logging and a social feed. Be honest, be kind, don't break the law, don't use the AI output as medical advice. We can change the service. You can leave any time.

fiveplate (“we,” “us”) provides the mobile and web app at fiveplate.com (the “Service”). By creating an account or using the Service you agree to these Terms and our Privacy Policy.

You must be at least 13 years old (16 in the EEA/UK) to use fiveplate. If you're using it on behalf of an organization, you represent that you have authority to bind that organization.

• You're responsible for activity on your account and for keeping your password secure.
• You can sign up with email + password, Apple, or Google. We rely on those providers to verify your email.
• You can delete your account at any time from Settings. Deletion is permanent — your meals, photos, comments, and follows are removed.

You keep ownership of the photos, captions, and other content you post (“Your Content”). You grant fiveplate a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (e.g. resize), and display Your Content as needed to run the Service — including showing it to other users in the feed, on your profile, and in competitions you join. This license ends when you delete the content or your account, except for backups that roll off on a normal schedule.

You represent that Your Content is yours to post and doesn't violate anyone else's rights.

You agree not to:

• Post content that is illegal, hateful, harassing, sexually explicit, or that depicts violence or self-harm.
• Impersonate someone else or misrepresent who you're affiliated with.
• Scrape, crawl, or copy the Service or other users' content without permission.
• Attempt to break, probe, or overload our systems, or interfere with other users.
• Use the Service to send spam, malware, or unsolicited promotional material.
• Submit photos that aren't actually food (e.g. to game competitions or streaks).
• Use automated means to inflate likes, follows, scores, or streaks.

We may remove content, suspend accounts, or terminate the Service for users who break these rules.

fiveplate uses AI (currently Google Gemini) to estimate calories and macronutrients from your meal photos. These estimates are approximate and can be wrong. They are for personal tracking and entertainment only. Do not rely on them for medical, dietary, or clinical decisions. If you have a medical condition, food allergy, eating disorder, or pregnancy-related dietary needs, consult a qualified professional.

Competitions inside fiveplate are between users and are not games of chance. We may adjust scoring, disqualify entries, or end a competition early if we detect cheating or technical issues. No prizes are guaranteed unless explicitly stated in the competition's description.

If we offer paid features in the future, the terms of purchase will be presented at the point of sale, and payments will be handled by the Apple App Store, Google Play, or another listed provider under that provider's terms.

You can stop using fiveplate and delete your account at any time. We may suspend or terminate your account if you violate these Terms, if your account creates legal risk for us, or if we discontinue the Service. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, governing law) will survive.

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the Service will be uninterrupted, error-free, or that AI estimates will be accurate.

To the maximum extent permitted by law, fiveplate will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) US$50 or (b) the amount you paid us in the 12 months before the claim.

You agree to indemnify and hold fiveplate harmless from claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms.

We may update these Terms from time to time. If we make material changes, we'll notify you in-app or by email before they take effect. Continued use of the Service after the effective date means you accept the updated Terms. We may also add, change, or remove features at any time.

These Terms are governed by the laws of the jurisdiction in which fiveplate is established, without regard to conflict-of-laws principles. Disputes will be resolved in the courts located in that jurisdiction, except where mandatory consumer-protection law gives you the right to sue locally.

If you obtained the iOS app from the Apple App Store, you acknowledge that these Terms are between you and fiveplate (not Apple), that Apple has no obligation to provide support for the app, and that Apple is a third-party beneficiary of these Terms entitled to enforce them against you. Your use of the app must comply with the Apple Media Services Terms.
